A s.66w certificate is a certificate signed by a solicitor or conveyancer acting for the purchaser which has the effect of waiving the purchaser’s 5 business day cooling off period. The requirements of the valid certificate are set out in section 66W of the Conveyancing Act 1919, hence the name.
It is usual for a section 66w certificate to be requested by a vendor when the subject property has a number of interested buyers. By requiring the purchaser to provide the section 66w certificate the vendor is assured that the property has been sold, as the purchaser has no cooling off period in which to withdrawal from the contract.
Before a buyer enters into a contract with a signed section 66w certificate it is important that the buyer is well prepared and in a position to proceed with the purchase. Prime Lawyers will provide buyers with a signed section 66w certificate as part of our fixed fee service. To do so we will require the buyer to tick off the following matters:
– unconditional finance approval in place
– condition of property investigated with pest and building report
– contract advice from Prime Lawyers obtained and understood
– deposit monies available

We were impressed with my solicitor from Prime Lawyers, both inside and outside of Court.
Prime Lawyers have treated all my matters with honesty and integrity. They have always returned my calls promptly and I will continue using them for my business.
My solicitor was very nice and professional. Prime Lawyers helped me with my first investment property. They were responsive with my questions via email or phone, helped me through the contracts and their professionalism made my purchase of the property very smooth. Thanks.
